1. RESPONSIBILITY OF USE & DISCLAIMER OF WARRANTIES

1.1 The Renter assumes full responsibility for the use, operation, and possession of all rented equipment. Any risks, including property damage or bodily injury (including death), are solely the Renter’s responsibility.

1.2 Occasio Event Rentals is not liable for any damage or injuries resulting from equipment use. No warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose, are provided.

1.3 All equipment is guaranteed to be in good working condition upon delivery.

1.4 This waiver does not apply to claims arising from Occasio Event Rentals’ gross negligence, intentional misconduct, or violations of applicable law.

2. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from this Agreement shall be resolved in the applicable courts of the State of Texas.

3. DISPUTE RESOLUTION & ARBITRATION

3.1 Any disputes arising from this Agreement shall be resolved through binding arbitration in the State of Texas, in accordance with the rules of the American Arbitration Association (AAA).

3.2 The prevailing party shall be entitled to reasonable attorney fees.

4. USER CONDUCT & PROHIBITED ACTIVITIES

The Renter may not:

  • Engage in fraudulent activities or misrepresent identity.
  • Tamper with website functionality or services.
  • Harass or abuse employees of Occasio Event Rentals.
  • Use the website or rented equipment for unlawful activities.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 No content from Occasio Event Rentals may be reproduced, copied, or redistributed without express written consent.

5.2 Trademarks, logos, and branding elements are protected and may not be used by third parties.

6. USER-GENERATED CONTENT LICENSE

By submitting reviews, comments, or images, the user grants Occasio Event Rentals a non-exclusive, royalty-free license to use, modify, and display the content for marketing purposes.

7. TERMINATION OF SERVICE

Occasio Event Rentals reserves the right to terminate service without notice if the Renter:

  • Violates any terms of this Agreement.
  • Engages in fraudulent activity.
  • Causes harm to Occasio Event Rentals' business.

8. ELECTRONIC COMMUNICATIONS & CONSENT

By using our site or renting equipment, the Renter consents to receive electronic communications, including:

  • Invoices
  • Agreements
  • Service updates
    via email or SMS.

9. FORCE MAJEURE CLAUSE

Occasio Event Rentals is not liable for delays, cancellations, or inability to perform obligations due to:

  • Acts of God (natural disasters, pandemics, extreme weather).
  • Government restrictions or emergency regulations.
  • Unforeseen events beyond our control.

10. INDEMNIFICATION CLAUSE

The Renter agrees to indemnify, defend, and hold harmless Occasio Event Rentals from any claims, damages, or legal fees arising from their use of rented equipment.

11. REFUND & CHARGEBACK POLICY

11.1 Unauthorized chargebacks will be disputed.

11.2 Refunds are issued at Occasio Event Rentals’ discretion and are subject to contract terms.

12. SECURITY DEPOSIT POLICY

  • A 25% security deposit is required at the time of booking.
  • Refunds are processed within seven (7) business days after equipment return, minus deductions for:
    • Damages
    • Cleaning fees
    • Missing items
  • Normal wear and tear include minor scuffs or dirt from reasonable use.
  • Deductions will be documented in writing in compliance with applicable state laws.
  • Cancellations within 14 days of the event will result in deposit forfeiture.
  • A credit card on file is mandatory for all orders.

13. PERMITS & LICENSES

13.1 The Renter is responsible for obtaining any necessary permits and licenses.

13.2 OCCASIO Event Rentals can provide guidance upon request.

13.3 The Renter must comply with all local ordinances, including noise permits for events after 10:00 PM, if required.

13.4 Equipment setup must not obstruct accessibility under the Americans with Disabilities Act (ADA).

14. PRICING & RENTAL PERIOD

  • Prices are based on a one-day rental period.
  • Extended rental options are available upon request.
  • Pricing is locked in upon contract signing.

16. DEFINITIONS

  • Equipment Failure: A malfunction rendering equipment unsafe or unusable.
  • Normal Wear & Tear: Minor scuffs or dirt from reasonable use.
  • Heavy Cleaning: Stains requiring professional remediation.
  • Weather Damage: Damage exceeding equipment’s rated use.
  • Regular Hours: 7:00 AM – 5:00 PM, Monday through Friday.
